Terms and Conditions
General Terms and Conditions (GTC) – VIVE GmbH (As of: April 2026)
1. Scope These General Terms and Conditions (GTC) apply to all orders placed via the online shop of VIVE GmbH, Chamerstrasse 176, 6300 Zug, Switzerland (www.vive.swiss). Deviating conditions of the customer are not recognized unless expressly confirmed by us in writing.
2. Offer and Conclusion of Contract The presentation of products does not constitute a binding offer, but a non-binding invitation to order. By submitting the order, you are making a binding offer. The contract is only concluded when we send you an acceptance (order confirmation) by email.
3. Prices and Shipping Costs All prices are in Swiss Francs (CHF) including statutory VAT (CH: 8.1%). For EU sales, prices are displayed including the respective national VAT (e.g., Italy 22%). Shipping costs are shown separately and are to be paid in addition to the product price. Price changes and errors reserved.
4. Payment Terms We accept the payment methods displayed in the shop (e.g., TWINT, credit card, PayPal, etc.). The charge will be made upon conclusion of the contract.
5. Delivery Delivery will be made to the address you provided. Delivery times are non-binding unless expressly assured. In case of unavailability, we will inform you immediately.
5.1 International Shipping (EU/Italy and International) We deliver to selected EU countries (incl. Italy) and other countries. Shipping costs and times are displayed during the order process. For deliveries to the EU, customs duties, import VAT, and other fees may apply, which must be borne by you. We do not cover these costs.
6. Right of Withdrawal / Returns For consumers in the EU (incl. Italy), there is a statutory right of withdrawal of 14 days from receipt of the goods. For Swiss customers, we voluntarily grant this right.
Exceptions to the right of withdrawal: Hygiene and cosmetic articles, if the seal has been removed (not suitable for return for reasons of health protection or hygiene, Art. 59 lit. e Codice del Consumo / EU law).
To exercise this right: Send us a clear declaration (e.g., by email to info@vive.swiss or using the sample withdrawal form). From June 19, 2026, an electronic withdrawal function ("Cancel contract" button) will be available in your customer account.
Consequences of withdrawal: We will refund all payments (including the cheapest standard shipping costs) within 14 days. You bear the return shipping costs (except in case of defect/wrong delivery). We may refuse repayment until we have received the goods back or you have provided proof of return.

7. Warranty and Liability The statutory warranty period in Switzerland and the EU is 2 years from delivery. Further claims (e.g., indirect damages) are excluded to the extent legally permissible.
8. Special Promotions and Vouchers Special promotions are time-limited and not retroactively applicable. Vouchers are not redeemable for cash and cannot be combined unless otherwise stated.
9. Retention of Title The goods remain our property until full payment.
10. Data Protection Personal data will be processed in accordance with revDSG (CH) and GDPR (EU). Details in our Privacy Policy.
11. Applicable Law and Jurisdiction Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Zug, Switzerland. For consumers residing in the EU/Italy, the mandatory consumer protection regulations of their country of residence apply.
12. Final Provisions Should individual provisions be invalid, the remainder remains valid.
